Acceptable Use Policy

1. Introduction
This Acceptable Use Policy ("AUP") governs your use of the BookMe Studio platform and all related services provided by Fusionix LLC ("BookMe Studio," "we," "us," or "our"). This AUP supplements and is incorporated into our Terms of Service.
This policy applies to all users of the Service, including Business Users (beauty and wellness professionals), Client Users (customers who book appointments), staff members, and website visitors. By using the Service, you agree to comply with this AUP.
2. Permitted Use
BookMe Studio is designed for legitimate business operations in the beauty and wellness industry. Permitted uses include:
- Managing appointments, schedules, and client bookings
- Processing payments for services rendered
- Communicating with clients about appointments and business updates
- Marketing your business to existing clients who have opted in
- Building and maintaining a business website through our template system
- Managing staff, inventory, expenses, and other business operations
- Booking appointments as a Client User and leaving honest reviews
3. Prohibited Content
You may not upload, publish, or transmit any content that:
- Is illegal, fraudulent, or promotes illegal activities
- Is defamatory, obscene, pornographic, or sexually explicit
- Promotes violence, hatred, or discrimination based on race, ethnicity, gender, religion, sexual orientation, disability, or any other protected characteristic
- Infringes on the intellectual property rights of others, including copyrights, trademarks, or trade secrets
- Contains malware, viruses, spyware, or any other malicious code
- Contains the personal information of others without their consent
- Is misleading, deceptive, or designed to defraud other users
- Violates any applicable law or regulation
4. Prohibited Activities
You may not engage in the following activities:
- Sending spam or unsolicited communications outside of the platform's built-in marketing tools
- Scraping, crawling, or using automated means to extract data from the Service without written permission
- Reverse engineering, decompiling, or disassembling any part of the Service
- Attempting to circumvent security measures, access controls, or rate limits
- Creating fake, fraudulent, or misleading reviews
- Making fake or fraudulent bookings
- Impersonating another person or business
- Using another user's account without their permission
- Reselling, sublicensing, or redistributing the Service without authorization
- Using the Service to compete with or benchmark against BookMe Studio
- Exploiting software bugs or vulnerabilities for personal gain (report them to us instead)
5. Marketing & Communications Rules
When using BookMe Studio's marketing features (email campaigns and SMS campaigns), you must comply with all applicable laws and the following rules:
- TCPA compliance (SMS). Only send SMS messages to individuals who have provided prior express written consent. Honor all opt-out (STOP) requests immediately. Do not send messages outside reasonable business hours.
- CAN-SPAM compliance (email). Include a clear unsubscribe mechanism in all marketing emails. Do not use deceptive subject lines or misleading "From" information. Process unsubscribe requests promptly.
- No purchased lists. You may only send marketing messages to individuals who have an existing relationship with your business and have opted in to receive marketing communications. Do not import or use purchased, rented, or scraped contact lists.
- Content standards. Marketing messages must be truthful, not misleading, and relevant to your beauty or wellness business. Do not use marketing tools to send content unrelated to your business services.
6. Payment & Financial Conduct
When using payment features of the Service, you agree to:
- Charge clients only for services actually provided or legitimately owed
- Maintain accurate, transparent pricing for all services
- Not use the platform for money laundering, terrorist financing, or any other illegal financial activity
- Not process fraudulent transactions or charge cards without authorization
- Not use the platform for card testing, card validation, or other payment fraud
- Comply with Stripe's terms of service and acceptable use policies
- Handle disputes and refunds in good faith and in compliance with applicable consumer protection laws
7. Platform Integrity
To maintain the security and reliability of the Service, you agree not to:
- Use bots, scripts, or other automated tools to interact with the Service without our prior written approval
- Attempt to overload, disrupt, or impair the Service or its infrastructure (denial-of-service attacks)
- Probe, scan, or test the vulnerability of the Service or any related system or network
- Interfere with other users' access to or use of the Service
- Attempt to gain unauthorized access to any part of the Service, other accounts, or systems connected to the Service
- Circumvent or manipulate rate limits, usage quotas, or marketing credit allocations
8. Reporting Violations
If you become aware of any violation of this AUP, please report it to us at legal@fusionix.tech. Please include as much detail as possible, including the nature of the violation, the user(s) involved, and any supporting evidence.
We take all reports seriously and will investigate promptly. We will not retaliate against anyone who reports a violation in good faith.
If you discover a security vulnerability, please report it responsibly to legal@fusionix.tech. Do not publicly disclose vulnerabilities before we have had an opportunity to address them.
9. Enforcement & Consequences
We reserve the right to investigate and take appropriate action against violations of this AUP. Depending on the severity and nature of the violation, consequences may include:
- Warning. A written notice describing the violation and requesting corrective action.
- Content removal. Removal of content that violates this AUP.
- Feature restriction. Temporary restriction of specific features (e.g., marketing tools, payment processing).
- Account suspension. Temporary suspension of your account pending investigation or corrective action.
- Account termination. Permanent termination of your account for serious or repeated violations.
- Law enforcement referral. Reporting of illegal activities to appropriate law enforcement authorities.
We will make reasonable efforts to notify you of enforcement actions and provide an opportunity to address the issue, except where immediate action is necessary to protect the Service or other users.
10. Changes to This Policy
We may update this Acceptable Use Policy from time to time. When we make changes, we will update the "Last updated" date at the top of this page. For material changes, we will provide notice through the Service or via email. Your continued use of the Service after changes take effect constitutes acceptance of the updated AUP.
